Pelvital Warranty Policy
Limited Warranty Terms
The following Warranty Terms apply to Flyte® device and system (“Product”) designed and owned by Pelvital USA, Inc. (“Pelvital”). Our Product is only available to end users through authorized distributors. Additional terms, conditions and limitations may apply depending on the distributor from whom you purchased or otherwise received the product, so please contact the distributor directly for more information. If there is a conflict between these Warranty Terms and the distributor terms, the distributor terms control to the extent of the conflict.
Shipping; Inspection.
Any order from a distributor that is fulfilled by Pelvital using drop shipment is shipped directly to the address you provided to the distributor. Any statement of delivery or shipping time is only an estimate and Pelvital will not assume liability, consequential or otherwise due to any delay or failure to deliver all or any part of any order for any reason.
Return Policy
The Product is a medical device and due to the personal nature of the Product, we are unable to accept returns other than returns under our limited warranty below. All purchases are non-returnable except as expressly provided under this limited Product warranty.
Limited Product Warranty
The Product comes with a 3-year product warranty from the date of purchase that covers malfunctions and manufacturer defects of the physical device (Controller, Wand, cables, charging block). You must promptly notify Pelvital and/or the distributor (as applicable) of any known warranty claims within the 3-year warranty period and cooperate in the investigation of such claims. If any Product is proven to not conform with this warranty during the applicable warranty period, Pelvital shall, at its option, either repair or replace the Product or refund the purchase price for each non-conforming Product, as your sole and exclusive remedy and Pelvital’s sole and exclusive obligation. Notwithstanding the foregoing, Pelvital shall have no obligation under the warranty set forth above if you: (a) fail to notify Pelvital in writing during the warranty period of a non-conformity; (b) use, misuse or neglect the Product in a manner inconsistent with the Product’s specifications or use or maintenance directions, (c) modify the Product or improperly install, handle or maintain the Product, or (c) combine the Product with other third party products.
If you have any concerns regarding product defects, please contact Flyte Customer Service for troubleshooting. For warranty claims, we will cover the cost of return shipping and the cost of shipping of replacement product, if applicable. Please check with the distributor for any additional requirements.
EXCEPT FOR THE WARRANTIES SET OUT ABOVE, NEITHER PELVITAL NOR ANY PERSON ON PELVITAL’S BEHALF HAS MADE OR MAKES FOR YOUR BENEFIT ANY EXPRESS OR IMPLIED REPRESENTATION OR WARRANTY WHATSOEVER, INCLUDING ANY WARRANTIES OF: (I) MERCHANTABILITY; (II) FITNESS FOR A PARTICULAR PURPOSE; (III) TITLE; OR (IV) NON-INFRINGEMENT; WHETHER ARISING BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE OR OTHERWISE, ALL OF WHICH ARE EXPRESSLY DISCLAIMED. YOU ACKNOWLEDGE THAT YOU HAVE NOT RELIED ON ANY REPRESENTATION OR WARRANTY MADE BY PELVITAL, OR ANY OTHER PERSON ON PELVITAL’S BEHALF.
Liability Limits
IN NO EVENT WILL PELVITAL, ITS AFFILIATES, AND RELATED ENTITIES OR ITS RESPECTIVE DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE PRODUCT, YOUR PURCHASE, DELIVERY OR USE OF OUR PRODUCT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING THE FOREGOING, PELVITAL’S AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT DURING THE TWELVE (12) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING. CERTAIN US STATE LAWS AND INTERNATIONAL LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
Usage Restrictions for End-Users
You agree that the Product is for your own personal use only. You must not and must not attempt to:
- service, repair, modify, alter, or access the internal components of the Product
- tamper with the Product
- reverse engineer or otherwise change any Product
- use the Product with unauthorized accessories or third party products
- bypass, disable or interfere with any safety or control features
- use the Product in a manner inconsistent with the Product specifications and instructions
- resell, lease, transfer or otherwise distribute the Product to a third party for use.
Any violation of these restrictions will immediately void the limited warranty for the Product.
