This Privacy Policy explains our practices, defines our users’ (“you” or “your”) privacy options, and describes how your information is collected and used by Pelvital USA, Inc. (“we,” “us,” “our,” or “Pelvital”).
By using the Pelvital website or our Platform, features, tools, or resources, you agree that you are over 18 years old and you agree to the terms of this Privacy Policy and our Terms and Conditions.
This Privacy Policy, along with our Terms and Conditions, governs your use of and access to (i) the Pelvital websites at www.flytetherapy.com, www.flytesystem.com, www.flyteforme.com and www.pelvital.com (collectively the “Site”), and (ii) the Platform. The “Platform” means the FLYTE® Mobile Application and associated Web Portal (including all data, content accessed by you and related documentation (“Application”), and the content, platform, tools, applications, data, software and services comprising Pelvital Flyte® device and Pelvital’s Flyte® System digital components, and related services.
We reserve the right to modify this Privacy Policy and will mark new versions with a corresponding “last updated” date. We recommend you visit the Site to review any changes in our practices. Your continued use of the Site and Platform constitutes your agreement to our then-current Privacy Policy.
Our Site or Platform may contain links to other websites. These websites may have privacy policies different than our Privacy Policy. The Site may also contain certain social media icons or widgets. Although you can view the material we have linked to, you may have to create an individual account or register to use these third-party social media sites to use interactive features. Any interaction on social media websites is governed by the terms of use and privacy policy of the particular platform.
What Information is Collected?
In this Privacy Policy, we refer to “personal information” or “personal data” which is data about an individual who can be identified from that data, or by combining it with other data. Personal information is usually your name in combination with another identifier, such as postal address, email address, telephone number, or government-issued identification number. Personal information does not include anonymous or aggregated data that can no longer be used to identify a specific person, even if combined with other data. The specific definition of personal information varies from one jurisdiction to another.
We may collect personal information from you on our Site when you visit our Site as a potential consumer or healthcare professional, contact us by phone or email, schedule a call for more information on our Platform, interact with us through our social media, schedule a demo as a healthcare professional, or complete our online questionnaire for urinary incontinence diagnosis, utilize chat to ask support or other questions, or any other interaction with our Site.
The information we may collect from the Site includes, but may not be limited to:
- Your name and email address to register to receive news updates and other company-related updates, promotions and materials from us;
- Your name, email address, phone number and any additional information you voluntarily provide to us through the “Contact Us” form on the Site as a consumer or healthcare professional;
- Certain health information you voluntarily provide to us by completing our online questionnaire for urinary incontinence or by completing any other questionnaire or form on the Site;
- Usage Data, like information regarding your browser and other technical specifications required to use our Site;
- Internet and network connectivity, such as browsing history or information on a user’s interaction with a website or application;
- Geolocation;
- Payment data, such as billing information from our business partners; and
- Inferences drawn from other personal information, such as profile information reflecting a person’s preferences.
Information Collected through the Platform
We may collect personal information from your use of or access to our Platform such as when you register for the Application, reach out to our experts for support for the Platform after you receive your Flyte®, register your Flyte® for warranty purposes, and other related interactions with our Platform.
The information we may collect from the Platform includes, but may not be limited to:
- Your name;
- Email address;
- Phone number;
- Shipping address;
- Account details for the Application, if you create an account to use with your Flyte®;
- Name and contact information of your healthcare provider;
- Your goals, your progress, and your incontinence history and status, as reported by you in the Flyte Mobile Application;
- Platform services data (for example the times and dates you complete treatment sessions using the Flyte Mobile Application);
- Data recorded by the Flyte device and captured by the Flyte Mobile Application; and
- Communications with us, including the information you provide to our experts for product support or when voluntarily participating in our product feedback program.
Health Information
We are a business associate as regards to any personal information we collect or process on behalf of covered entities that is considered Protected Health Information under the Health Insurance Portability and Accountability Act (“HIPAA”). If you are a resident of Washington state or another state with similar consumer health privacy law, please see our “Consumer Health Data Privacy Policy” for more information on how we process your health data.
Usage Data
Usage Data is collected automatically when using our Site. Usage Data may include information such as your device's internet protocol address (e.g. IP address), browser type, browser version, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data. when you access the Site by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device unique id, the IP address of your mobile device, your mobile operating system, the type of mobile internet browser you use, unique device identifiers and other diagnostic data.
We do not collect any such Usage Data, including geolocation information, from you when you use the Platform.
How is User Information Used?
We collect information about you in order to provide our Site and Platform to you and provide you with a better experience. We also collect information that is necessary for the Site and Platform to work properly.
We use personal information about our users for a variety of purposes related to our business, including but not limited to:
- Allowing you to receive information from us regarding the Platform, educational webinars or other educational services, news updates and other company-related updates, promotions and materials;
- Tracking information about your visits to our Site or use of the Site to allow us to provide better tailored user experience;
- Using certain online preferences in the aggregate across all users to evaluate the Site and develop additional products and services to offer;
- Using aggregated de-identified personal information from the Platform to publish results of feedback program, outcomes and trends in users, and develop additional products and services, and marketing campaigns;
- Sending information you sign up for on the Site, such as quiz results and related educational information;
- Sending or initiating direct marketing programs from your interactions with our Site, such as newsletters or information about new products or services we are offering;
- Contacting you regarding an inquiry on the Site or Platform that you have initiated;

- Other purposes necessary to carry out our obligations under this Privacy Policy or our Terms and Conditions.
We may disclose information, in the aggregate, regarding your online browsing preferences to evaluate our products or allow third parties we work with to better serve our users. We will not disclose personally identifiable information in these instances, other than as described in this Privacy Policy.
How is User Information Disclosed?
Service Providers
We may provide user information to third-party service providers or vendors for purposes of, including without limitation, processing payments for our B2B transactions, initiating direct marketing programs on our behalf, data tracking, maintenance or development of our Site and Platform, development of online products and services or customer service or new product development, or other contracted promotional opportunities provided to our users.
We will not disclose your information collected from your use of or access to the Platform with third parties to directly market their products to you.
Shopify
We use Shopify to process, orders for our business customers. In this context, Shopify acts as our service provider and we may disclose your information with Shopify to process orders on our behalf. However, Shopify may also process limited personal information, provide, develop, and improve its analytics, advertising and other products. By using our Site, you consent to allow Shopify to collect personal information about you, and place cookies necessary for our Site to function during transactions. Affiliates, Partners, and Related Entities
We may disclose personal information with any subsidiaries, licensees, suppliers, distributors, partners, affiliates, assigns, successors or other related entities and their respective owners. Such information can include contact form submissions, email address for email marketing and newsletters, and certain usage data and analytics. Some of our partners and distributors may use this information for their own business purposes, including marketing, analytics, and customer outreach in accordance with their own privacy policies.
Business Transfers
We may disclose your information to a third party as part of reorganization or a sale of the assets of Pelvital, or its subsidiaries or divisions. Any third party to which Pelvital transfers or sells the Site or Platform or related assets will have the right to continue to use the personal and other information that you have provided to us.
Law Enforcement
Pelvital reserves the right to use or disclose information, including personal information, if required by law or if Pelvital reasonably believes that use or disclosure is necessary to protect Pelvital rights and/or to comply with a judicial proceeding, court order, subpoena, or legal process. In certain situations, Pelvital may be required to disclose your personal information in response to lawful requests by public authorities, including to meet or assist national security or law enforcement requirements.
We may also disclose your personal information as required by law, such as to comply with a subpoena or other legal process, when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.
Children Under the Age of 18
Our Site and Platform are not designed for or targeted to children, and we do not knowingly collect information from any person under the age of 18. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us. If we become aware that we have collected personal data from anyone under the age of without verification of parental consent, we take steps to remove that information from our servers.
Tracking Technologies, Cookies and Pixels
We do not use any cookies, pixels or other tracking technologies on or through the Platform.
We use cookies, pixels and similar tracking technologies to track the activity on the Site and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze our Site. The technologies we use on the Site may include:
- Cookies or Browser Cookies. You can instruct your browser to refuse all cookies or to indicate when a Cookie is being sent. However, if you do not accept cookies, you may not be able to use some parts of our Site. Unless you have adjusted your browser setting so that it will refuse cookies, our Site may use cookies.
- Web beacons. They are also referred to as clear gifs, pixel tags, and single-pixel gifs) and permits Pelvital, for example, to count users who have visited those pages or opened an email and for other related website statistics (i.e, recording the popularity of a certain section and verifying system and server integrity).
- Pixels are small transparent images embedded in a site, email or ad and may provide information to platforms who may combine your information with other information they have about you. We use pixels to automatically collect information when you visit our Site. These technologies usually track advertising preferences from site to site, and gather data about a users’ browsing habits to improve the user experience. You may seek to block tracking pixels by installing a dedicated browser extension or ad-blocking extension for that purpose or by adjusting your browser privacy settings.
We use both session and persistent cookies on the Site. Persistent cookies remain on your personal computer or mobile device when you go offline, while session cookies are deleted as soon as you close your web browser. The category of cookies we use on the Site are:

Behavioral Interest Based Advertising
Our Platform does not have any interest based advertising or analytics. For our Site, we may use third-party vendors, such as Google Analytics, to advertise to our users online. These third-party vendors may display Pelvital product advertisements on other websites based on your internet usage. More specifically, these vendors use first-party cookies and third-party cookies (such as the DoubleClick cookie) together to inform, optimize, and serve ads based on your past visits to the Site or another site affiliated with Pelvital products or services. Any information that these third parties collect via cookies is not linked to any personally identifiable information (name, address, email address or phone number) we collect or you provide on the Site. You can opt-out of Google Analytics by using Google’s Ads Settings.
Please note that even if you opt out of interest-based advertising by a third party, these tracking technologies may still collect data for other purposes, including analytics, and you will still see ads from us, but the ads will not be targeted based on behavioral information about you and may therefore be less relevant to you and your interests.

How is User Information Protected? How long is User Information Retained?
We maintain administrative, physical, and technical safeguards for all user information collected on our Platform and Site. However, no security measure is foolproof, and no method of data transmission can be guaranteed against interception or misuse. We cannot guarantee complete security of any information you transmit to us.
We retain data collected from you only for as long as necessary to complete the purpose for which it was collected.
Communication Preferences
While we work hard to use and disclose our users’ personal information only for the purposes identified above, you can choose not to provide personal information or limit the personal information obtained by us as follows:
- You may have your contact information removed from our marketing lists by clicking on the unsubscribe link in any communication received from us, or by emailing us at info@pelvital.com. Please note that you may still receive transactional non-marketing messages from us.

SMS DATA
By providing your phone number through our Services, you consent and agree to receive recurring auto-dialed marketing SMS text customer services, transactional messages for product support and marketing messages. Message frequency depends on the offers and services we provide. Reply “HELP” for help, and “STOP” to cancel. Messaging and data rates may apply. Your consent for SMS is not required to purchase our products or services.
We may disclose your SMS opt-in or consent status, with third parties that help us provide our messaging services and send the text messages. We will not share or sell your phone number and your opt-in to the SMS with unaffiliated third parties for their direct marketing purposes or for purposes unrelated to the Services. You may opt out of receiving SMS text marketing messages by texting “STOP” at the end of any message you receive, or you can contact us at support@flytetherapy.com. You may receive an additional mobile message confirming your decision to opt out. You understand and agree that the foregoing options are the only reasonable methods of opting out. Other States’ Privacy Rights
A number of US states may provide their residents with certain privacy rights. Depending on how the applicable privacy law defines a “sale,” we may sell personal information to third parties in connection with the Site. We also use cookies and tracking technologies on our Site to display advertisements about our Platform to you on nonaffiliated website, applications, and online services.
